				<content:encoded><![CDATA[<p>Well, it&#8217;s finally happened. Even though our channel is very careful about the music we use, a big record label has stepped in and bullied YouTube into threatening to delete Beat Down Boogie and all our videos. The kicker &#8211; we had multiple written permissions to use the music in question.<br />
<span style="color: #800000;"><span style="color: #333333;">Despite that permission,</span> </span><span style="color: #800000;"><strong>The Orchard (aka The Orchard Music Group)</strong></span> filed a claim against our Really Really Long Dragon*Con 2011 Video.  Don&#8217;t go looking for it &#8211; Youtube deleted it. The video was one of our most beloved labors of editing and a fan favorite &#8211; and it showcased the creativity of thousands of participants at D*Con.</p>
<p><strong><span style="color: #800000;">We secured permission from all of the music artists and labels involved before we shot the video. Then we heavily promoted their itunes stores in the video and in its description.</span></strong> The artists were very happy with the result, and with their new fans. I have nothing negative to say about the artist whose song triggered this claim. They are talented and I appreciate their generosity in granting us permission to use their music. <strong><span style="color: #800000;">I&#8217;m only upset that I can no longer promote their work to our fan base &#8211; even with permission &#8211; for fear of The Orchard Music Group.</span></strong> <strong><span style="color: #800000;">I would suggest that all music artists rethink working with The Orchard &#8211; because tactics like these leave a real sour taste in the mouths of potential fans and customers.</span></strong>  Not only were we forced to cease promoting the artist represented by The Orchard (despite that artist&#8217;s wishes), there were several other artists in this D*Con video that were enjoying the agreed-upon promotion, who&#8217;ve been negatively affected by The Orchard.  I should also note that we were not making any revenue off of that video.  And this was not a video that people would use to acquire the music.  For one, the music tracks were not used in their entirety.  Two, there were crowd sounds over top.  And three, the video was 25 minutes long.  None of those details are really relevant though, because we had permission to use all of the music.</p>
<p>If you try to contact Orchard Music Group over a concern like this, you only get an automated response &#8211; one that proved no help. If you&#8217;re a music artist, just be aware that there are not live employees helping to evaluate and avoid these types of misunderstandings. <strong><span style="color: #800000;">If you want to make sure the companies you work with don&#8217;t leave a dark stain on your band&#8217;s brand integrity &#8211; accidentally or intentionally &#8211; you may want to avoid The Orchard.</span></strong></p>
<p><strong><span style="color: #800000;">As a media creator, I understand the need to protect one&#8217;s work. But it must be done honestly.</span></strong> I explained to The Orchard that I had written permission to use the song and offered to forward the relevant emails. That I had permission is the reason the video existed on Youtube without conflict for nearly two years. If some circumstance had changed with the label I would have been happy to work with The Orchard to find an amiable solution &#8211; even if that meant re-uploading a different version without their music on my own accord. Instead of responding to me or acknowledging the written permission, The Orchard insisted (despite my available proof) that the permission didn&#8217;t exist and demanded that Youtube delete the video &#8211; a process which also resulted in our channel being threatened with deletion.</p>
<p>Ours is a channel that dozens of people have poured blood sweat and tears into for years. <strong><span style="color: #800000;">It is obvious how quickly a big faceless corporation like The Orchard can dismiss the hard work of small artists. And how little respect they have for people trying to do the right thing by actually securing permission to use music.</span></strong> Having dabbled in music production when I was younger, I am terrified to think of how the label&#8217;s artists might be treated. One things for sure, The Orchard is definitely not doing them any PR favors by harassing small artists.</p>
<p>Unfortunately Google allows labels like The Orchard complete control of what is allowed on Youtube. Any of these labels can claim the music in a video &#8211; even if their music doesn&#8217;t actually appear in a video &#8211; and that begins an automated claims process. This automated process occurred with each artist in our Really Really Long Dragon*Con 2011 Video. But each label showed integrity by acknowledging the written permission we received from the labels and artists. Each label showed integrity, that is, except for The Orchard Music Group.</p>
<p>I opened Youtube only to find it blocked. I faced a bright red message &#8211; Youtube was threatening to delete our channel and all our videos thanks to The Orchard Music Group. To proceed, I had to click an &#8220;acknowledge&#8221; button informing me I was required to delete the video. Instead of being able to go to my video controls, I was then forced to watch a child-like movie about copyright infringement and take a quiz. Talk about adding insult to injury. When I was finally able to access our Youtube Channel again &#8211; I realized that YouTube had already removed the video….so I don&#8217;t know why they gave me a message insisting that I delete it.</p>
<p><strong><span style="color: #800000;">In the end, our ability to counter-claim on Youtube is an illusion. Because the big labels can veto and disregard any counter-claim &#8211; regardless of the facts &#8211; and Google will side with the big labels without question.</span></strong></p>
<p>A lesson for other YouTubers &#8211; if The Orchard Music Group makes a claim against your video, just take down the video down on your own before The Orchard makes Youtube threaten to delete your channel and ALL of your videos.  It does not matter if you have permission &#8211; from our experience, The Orchard will ignore any proof and dismiss your counter-claim.  <strong><span style="color: #800000;">It is safer to just not promote any music or artists in their catalogue.</span></strong></p>
<p>We make Dragon*Con videos for the participants of D*Con and fans of costuming, cosplay, and creativity world-wide. It is a shame that The Orchard had to put an end to one of the best expressions of this goal &#8211; despite us having permission to use the music.</p>
<p>We&#8217;re sorry to all the people who loved watching this video, especially with another D*Con coming up.  We&#8217;ll do our best to find the original files and re-do the music if possible.  Obviously we will never again feature or promote a band represented by The Orchard.  And for any video&#8217;s like this, we will be sure to put a warning about working with The Orchard, for the sake of all our fellow artists.</p>

Several fans of Mario Warfare have asked us about our production schedule for upcoming Mario Warfare episodes.  I wanted to take a second to share our insight on the film-making process.  It&#8217;s a long process filled with lots of effort.  Even for Hollywood films with a 100 million dollars, and 100&#8242;s of crew members working full time, it can take years to finish a film.  We have like, 3 crew and work around our day jobs, lol.  Here&#8217;s what we&#8217;ve been up to since Episode 2, and what we will be up to in the near future!<br />
<span id="more-2896"></span></p>
<p><strong>KICKSTARTER.</strong>   After Episode 2, we ran out of money to make more Mario Warfare episodes.  But we wanted to give fans the chance to see a complete saga!  So we developed a Kickstarter project and it succeeded!  Once a Kickstarter is complete, it actually takes a couple weeks for Kickstarter to collect the contributions and transfer them to the project.</p>
<p><strong>WRITING.</strong>  Because of the amazing Kickstarter support, we were able to expand Mario Warfare&#8217;s story to include new characters, locations, and scenes.  This also meant we had to go back to the script and write a lot more.</p>
<p><strong>RESEARCH.</strong>  Even with funding, we have to base the script on obtainable costumes, props, and locations.  Creating costumes from scratch might take too long, and building complete sets is beyond our budget.  So before we could even write a new script, we had to research available locations, costume pieces, prop materials, etc..</p>
<p><strong>SHOPPING.</strong>  Once we had a script, we did a &#8220;script break-down.&#8221;  We made a note of every item in the script and went shopping for it.</p>
<p><strong>WAITING ON SHIPPING.</strong>  Amazon Prime&#8217;s free two-day shipping is one of the best deals for filmmakers.  However, not all items are available on Amazon, or offered under Prime.  So we had to spend weeks waiting for certain costumes and props to arrive.</p>
<p><strong>COSTUMES AND PROPS.</strong>  As we received materials, we began assembling props and costumes.  We built a giant barrel and a big warp pipe.  We modified clothing, and painted armor and accessories.</p>
<p><strong>LOCATIONS.</strong>  Finding locations can be one of the trickiest tasks for a small film crew.  We&#8217;ve spent days searching for interesting locations (physically and online), trying to find the owners, and secure permission to use them.  We were super fortunate to meet a family of amazing artists that has allowed us to use a couple of their properties for Mario Warfare.</p>
<p><strong>CASTING.</strong>  Due to the Kickstarter support, we&#8217;ve been able to add several more Nintendo-inspired characters to the series.  We&#8217;ve also been able to film bigger scenes with lots of extra actors.  So we spent a couple weeks casting new characters and organizing extras.</p>
<p><strong>SCHEDULING.</strong>  With such a big cast of heroes and villains, scheduling can be tricky.  But the cast of Mario Warfare has gone out of their way to make themselves available. </p>
<p><strong>FILMING.</strong>  We all have day jobs, so we can really only film on the weekends.  Most film days include several hours of organizing, driving, and setup, then 9 or 10 hours of filming.</p>
<p><strong>RAIN DELAYS.</strong>  Much of Episode 3 and 4 happen outdoors, so we do have to contend with the weather.  We&#8217;ve been rained out two weekends during the filming of Episodes 3 and 4.</p>
<p><strong>Here&#8217;s some of the stuff we still need to work on.</strong><em></p>
<p><strong>EDITING.</strong>  Micah has been editing as much as he can in the evenings after his day job.  That keeps the weekends free for filming.  Editing is the longest part of the film-making process.  It involves going through weeks of footage, tens of thousands of clips, then cutting and recutting it together to find the best flow for each scene.  Once we&#8217;ve filmed everything we can, then Micah will start editing on the weekends as well.</p>
<p><strong>FOLEY AND ADR.</strong>  The way we shoot is quick and intense.  It allows us to get a lot of coverage in a short time.  However, it often leaves us with poor audio.  Most of the sound effects and background noises have to be recorded and added in post.  That process is called &#8220;foley.&#8221;  For any dialogue which doesn&#8217;t come out well, we have to dub over it in our home studio.  That process is called &#8220;ADR.&#8221;</p>
<p><strong>VISUAL EFFECTS AND CG.</strong>  Scenes like the flying ships from Episode 1 take Rick and his brother Chris a few weeks to create.  Muzzle flashes, blood sprays, and lighting effects can take several days to apply.</p>
<p><strong>SCORE.</strong>  The score is an important part of Mario, and even for a quick and talented composer like Karel Antonin, it takes a while to compose the parts of a orchestra, then modify pieces to suit the director and editor&#8217;s vision.</p>
<p><strong>CREDITS.</strong>  The end credits usually take a few days to create, partly because we like cool visual credits created in After Effects.  But mostly because we have to remember all the people who helped make Mario Warfare, and that can take a while.</p>
<p><strong>EXPORTING AND UPLOADING.</strong>  For something important to us like Mario Warfare, we want to make sure the Youtube video looks great.  Which means a very long high-quality encoding process (which takes hours).  Encoding to a compressed video format can change details like color saturation and contrast.  Then Youtube re-encodes the video (which takes hours), and those little visual details may change again.  We usually export and upload several versions to make sure the final version on Youtube looks right.  This sometimes takes a few days.</p>
<p>So that&#8217;s the short version of what goes into a web series like Mario Warfare.  It may look intimidating, and it is a big challenge, especially for a small crew like ours (depending on the day our crew usually consists of 1 to 4 people).  But it&#8217;s all about learning and incorporating a new task with each project.</p>

This coming weekend, March 23rd &#038; 24th, we have a couple full days of shooting that not only includes lots of fight scenes with the cast of Mario Warfare but we&#8217;ll also be incorporating many old school video game characters. Filming will continue into April and we&#8217;ll see the addition of new cast members including our old friend Eric Jacobus of <a href="https://www.facebook.com/stuntpeople" target="_blank">The Stunt People</a> who recently wrapped up filming on season 2 of <a href="http://youtu.be/5l3jrR5XMSU" target="_blank">Mortal Kombat Legacy</a> where he plays Stryker.<br />

I saw six steady cam rigs and countless cameras on my first day at Katsucon. This event seems geared to cosplayers and photographers teaming up to create great images. This shot of Yaya Han by <a href="https://www.facebook.com/elysiamguild" title="Elysiam Entertainment">Elysiam Entertainment</a> is a perfect example.<br />

Katsucon was a perfect opportunity to test out my new camera, the Canon 5dmk3.  The cosplayers were happy to pose and move for the camera.  In fact they were already prepared for it because Katsucon is frequented by some big names in cosplay photography &#8211; <a href="http://www.youtube.com/user/acksonl" title="AcksonL">AcksonL</a>, <a href="https://www.facebook.com/AnnaCosplayPhotography" title="Anna Fischer">Anna Fischer</a>, <a href="https://www.facebook.com/elysiamguild" title="Elysiam Entertainment">Elysiam Entertainment</a>, and <a href="https://www.facebook.com/martinwongphotography" title="Martin Wong">Martin Wong</a> just to name a few.   I&#8217;m used to filming the crazy candid party atmosphere of Dragon*Con.  While Katsucon is more laidback, it allowed me to really examine and appreciate the high quality of costuming.  I tried to capture some of that on film&#8230;err, in bits&#8230;whatever&#8230;it&#8217;s digital.</p>
<p>I picked up some tips and tricks from the cameramen and women with more professional gear than myself.  AcksonL recommended an amazing lens that I am now using for Mario Warfare.  And at night, Toad and I did our part to guest-lecture on partying alongside the pros from Elysiam Entertainment and The League of Hot Geeks.  We checked out all the hotel bars, ended up boogying at a hip hop club, and visited a party suite run by friends we met at Magfest!  (There may or may not have been a situation involving me wearing a lampshade &#8211; a situation previously reserved for cartoons and sitcoms).<br />

We actually ended up going beyond our goal, which means in addition to new episodes of Mario Warfare, you&#8217;re going to see our leading man Matt Sumner rocking a Sailor Moon outfit!</p>
<p>While we&#8217;re in pre-production for Episode 3, we&#8217;re also in the process of fulfilling our more immediate Kickstarter rewards. Those include assembling a thanks roster for our website, making a shout-out video for our channel, and editing some special behind-the-scenes videos for our backers.</p>
<p>It will take a while to get Episode 3 together. For anyone new to the film-making process, here&#8217;s an idea of what to expect. We&#8217;re currently doing some script re-writes while we wait for the final Kickstarter funds to transfer. Once that happens, we&#8217;ll be ordering new costumes and props for episode 3, arranging locations, and scheduling shoots. We&#8217;ll have to do some custom work on the props and costumes when they arrive. Then we&#8217;ll be ready to film, which we do on the weekends. In the weekday evenings, Micah starts capturing and organizing all the footage. We also convert it to a different format that&#8217;s easier to edit. After all the scenes are shot, Micah continues to cut the first rough cut, which he sends to our composer Karel. From then on, we finish sound effects, visual effects, music, color correction, credits, etc.</p>
<p>Even though it will take a while to get Episode 3 together, the following episodes should come together faster thanks to your support! Thank you for helping us do what we love to do and helping create more Mario Warfare!</p>

They are all <a href="http://www.ehobbyasia.com" target="_blank">airsoft</a>, which is a great option for film-makers.  New aspiring film-makers can choose super-inexpensive plastic airsoft guns which look pretty realistic, but are usually lightweight and missing close-up details.  Film-makers wanting a little more realism can choose <a href="http://www.ehobbyasia.com" target="_blank">full-metal airsoft guns</a>.  These versions are more expensive but usually have realistic weight (which is great for actors), moving parts, and sometimes authentic markings (great for closeups).  In addition, some gas-powered airsoft guns feature blowback action on the pistol slides and rifle charging handles &#8211; this gives an extra boost to realism, though it requires film-makers to buy and keep up with gas canisters.</p>
<p>We&#8217;ve been investing in the nice full-metal airsoft rifles for some time.  They&#8217;re more hardy than the cheap plastic guns, and more modular.  That means if we damage a piece, we can fix or replace that specific piece, as opposed to replacing an entire prop gun.  Our favorite supplier is <a href="http://www.ehobbyasia.com" target="_blank">www.ehobbyasia.com</a>  They have a great selection and warehouse prices.  They are a Hong Kong outlet, so international shipping can get pricey.  However, we usually save money overall because of the lower price of the items.  For instance we might pay $50 in shipping, but save $100 on the items.  Shipping is super-fast.  We usually receive items in about 5 days, and the packaging is immaculate.</p>
<p>The most iconic guns in Mario Warfare are Toad&#8217;s Mac 10s.  They&#8217;re Tokyo Marui, a top-shelf Japanese brand.  So far, most of the guns in Mario Warfare have been wielded by the Shyguys, who carry a mix of modern rifles, including the Magpul Masada, FN Scar, HK 416, Custom M4&#8242;s, FAMAS, g36, and even a Tavor.</p>

<p>Cos Patrol is Distractotron&#8217;s spin on COPS and Reno 911.  After MGS4, Old Snake has settled down as a beat cop, patrolling the streets of a city filled with game and movie characters.</p>
